CALIFORNIA DOG BITE LAW, CIVIL CODE SECTION 3342

In many states there are specific laws pertaining to dog bite claims.  While these states only allow dog bite claims after a dog has been declared vicious, California has no such rule.  In California, if an individual is injured as a result of a dog bite or other animal attack, the owner of the animal is held strictly liable and responsible for the facial injuries or other harm. 

Under California law, the victim must prove the defendant owned the dog, the dog bit the individual, the individual was properly on the premises where the dog bite occurred, and the dog bite caused the injuries. 

Back in 1997, our dog bite attorney Keith More tried a case where the defense was that the dog did not actually close his mouth and bite the child in the face.  A plastic surgeon was called in and was able to testify that the lacerations to the lips and mouth clearly demonstrated that the dog had bit the child’s face.  The jury did not believe the defense that was put forth by the insurance company’s lawyers and found in favor of the injured child. 

People are often concerned about pursuing dog bite liability cases in fear that it may jeopardize relationships with neighbors or others.  However, compensation for dog bite liability is usually obtained through the owner of the dog’s homeowner insurance policy or, rental insurance policy or other means, usually resulting in no financial consequence to the owner.
